This issue of Asian Dispute Review commences with an article by Bronwyn Lincoln which provides several reasons why determination ‘on the papers’ is a genuine option for commercial parties. Anuska Shah and Krisha Jethani then discuss choice of law issues in arbitrations involving contracts between Indian parties.

This is followed by Alipak Banerjee and Payel Chatterjee’s article, which discusses issues relating to the impact of insolvency on arbitration. Cristina Wagner Mastrobuono and André Junqueira Rodrigues then discuss important considerations arising from arbitration with public entities in Brazil and what Asian investors need to know in advance when negotiating contracts.

For the In-house Counsel section, Wilson Lui discusses the indemnity costs approach to unsuccessful arbitral award challenges. This is followed by Roberto N Dio & Byron Perez’s article for the Jurisdiction Focus section, which examines recent developments in international arbitration in the Philippines.

Finally, Professor Tan Cheng-Han reviews Lawyer, Scholar, Teacher and Activist: A Liber Amicorum in Honour of Derek Roebuck.
